These Terms and Conditions ("Terms") govern all services provided by Muddy Waters Moving Company Inc., TOK DUMP (Talk Dump), and associated operations including The Purple Lotus Commons (collectively referred to as "the Company").
By booking or using our services, you agree to the following Terms.
1. Services
The Company provides moving, junk removal, hauling, donation pickup, and related services for residential and commercial clients. Services may include loading, unloading, transportation, disposal, and handling of items as agreed upon at the time of booking.
2. Pricing
All pricing is based on estimates provided prior to or at the time of service. Final charges may vary depending on actual time, volume, weight, access conditions, materials required, and additional services requested.
Minimum charges may apply. Additional fees may apply for heavy items, long carry distances, stairs, disassembly, or unforeseen conditions.
3. Liability, Damage, and Item Responsibility
While reasonable care is taken, the Company is not responsible for:
• Pre-existing damage to items or property
• Damage to items not properly packed, secured, or prepared
• Fragile items unless disclosed in advance
• Mechanical or structural failure of items during moving
The Company’s liability, where applicable, is limited to a reasonable repair or replacement value and does not include sentimental or consequential damages.
4. Access and Site Conditions
Customers must ensure safe and reasonable access to the service location, including parking, entrances, elevators, and pathways.
The Company is not responsible for delays or additional costs caused by restricted access, unsafe conditions, weather, or building regulations.
5. Payment Terms
Payment is due immediately upon completion of services unless otherwise agreed in writing.
We accept cash, debit, credit, and other approved payment methods.
Late payments may be subject to additional fees.
6. Cancellations and Rescheduling
Cancellations or rescheduling requests should be made as early as possible.
The Company reserves the right to charge a cancellation fee for short-notice cancellations or missed appointments.
7. Donations, Disposal, and Recycling
Items collected may be donated, recycled, or disposed of at the Company’s discretion.
The Company does not guarantee that items will be donated.
Once items are removed, ownership is transferred to the Company.
8. Prohibited Items
The Company reserves the right to refuse removal of hazardous materials, illegal items, or items deemed unsafe, including but not limited to chemicals, explosives, biohazard materials, or improperly contained waste.
9. Independent Contractors
Some services may be performed by independent contractors. These contractors are not employees of the Company but are qualified service providers operating under agreement.
The Company is not liable for actions outside the agreed scope of work.

11. Governing Law
These Terms and Conditions are governed by the laws of the Province of Manitoba, Canada.
Any disputes arising from services provided shall be subject to the jurisdiction of Manitoba courts.r their own insurance, licensing, and operations.
